Dear Mr. Hays:
You ask whether certain information is subject to required public disclosure under the
Public Information Act (the “Act”), chapter 552 of the Government Code. Your request
was assigned ID# 26-009782 (Ref. COHM-R003232-0211 26).
The City of Humble (the “city”), which you represent, received a request for certain
information pertaining to a specified property. You state the city has released some of the
requested information. You state, although the city takes no position with respect to
whether the submitted information is excepted from disclosure, its release may implicate
the interests of third parties. Accordingly, you state, and provide documentation showing,
you notified these third parties of the request for information and of their right to submit
arguments to this office as to why the submitted information should not be released.1 See
Gov’t Code § 552.305(d); see also Open Records Decision No. 542 (1990) (statutory
predecessor to section 552.305 permits governmental body to rely on interested third party
to raise and explain applicability of exception in the Act in certain circumstances). We have
reviewed the submitted information.
An interested third party is allowed ten business days after the date of its receipt of the
governmental body’s notice under section 552.305(d) of the Government Code to submit
its reasons, if any, as to why requested information relating to it should be withheld from
disclosure. See Gov’t Code § 552.305(d)(2)(B). As of the date of this letter, this office has
not received comments from a notified third party explaining why its information should
not be released to the requestor. Thus, we have no basis to conclude the release of the
information would implicate a third party’s interests, and none of the information may be
withheld on that basis. See, e.g., id. § 552.110 (requiring provision of specific factual
evidence demonstrating applicability of exception).

Section 552.101 of the Government Code excepts from public disclosure “information
considered to be confidential by law, either constitutional, statutory, or by judicial
decision.”2 Id. § 552.101. This section encompasses information protected by chapter 418
of the Government Code. As part of the Texas Homeland Security Act (the “HSA”),
sections 418.176 through 418.182 were added to chapter 418 of the Government Code.
These provisions make confidential certain information related to terrorism or a hostile act
by a foreign adversary of the United States. Section 418.181 of the Government Code
provides the following:
Those documents or portions of documents in the possession of a governmental
entity are confidential if they identify the technical details of particular
vulnerabilities of critical infrastructure to an act of terrorism or a hostile act by a
foreign adversary of the United States.
Id. § 418.181; see also id. § 421.001(2) (defining “critical infrastructure” to include all
public or private assets, systems, and functions vital to security, governance, public health
and safety, economy, or morale of state or nation). The fact that information may relate to
a governmental body’s security concerns does not make the information per se confidential
under the HSA. See Open Records Decision No. 649 at 3 (1996) (language of
confidentiality provision controls scope of its protection). We note the submitted
information identifies details and locations of components of the city’s utility systems.
These systems are critical infrastructure for purposes of section 418.181. See Gov’t Code
§ 421.001(2). However, we are unable to determine whether the information at issue would
identify the technical details of particular vulnerabilities of the city’s critical infrastructure
to an act of terrorism or a hostile act by a foreign adversary of the United States.
Accordingly, to the extent the city determines the information would identify the technical
details of particular vulnerabilities of the city’s critical infrastructure to an act of terrorism
or a hostile act by a foreign adversary of the United States, the city must withhold such
information under section 552.101 in conjunction with section 418.181. To the extent the
city does not make such a determination, the information is not confidential under section
418.181 and may not be withheld under section 552.101 on that basis. The remaining
information must be released.
This letter ruling is limited to the particular information at issue in this request and limited
to the facts as presented to us; therefore, this ruling must not be relied upon as a previous
determination regarding any other information or any other circumstances.

said subdivision and development plan of said property according to all lines, dedications,
restrictions and notations on said maps or plat and hereby dedicate to the use of the public
forever, all streets (except those streets designated as private streets or permanent access
easements), alleys, parks, water courses, drains, easements and public places shown thereon and
anconsiderations herein ex ressed• and do hereby bind ourselves our heirsforthepurposesdtpy ,
successors and assigns to warrant and forever defend the title on the land so dedicated.
FURTHER, Owners do hereby dedicate to the public a strip of land forty (40) feet wide
on each side of the center line of any and all bayous, creeks, gullies, ravines, draws,
sloughs, or other natural drainage courses located in said plat, as easements for drainage
purposes, giving the City of Humble, Harris County, and any other governmental agency, the
right to enter upon said easement at any and all times for the purpose of construction and
maintenance of drainage facilities and structures.
FURTHER, Owners do hereby covenant and agree that all of the property within the
boundaries of this plat shall be restricted to prevent the (drainage of any septic tanks into
any public or private street, permanent access easement, road or alley or any drainage
ditch, either directly or indirectly.
